GENERAL TERMS AND CONDITIONS OF USE 

 

The following terms used in the general conditions of use (hereinafter "GCU") will have the meaning indicated below:

SOLOSAR: means the company SOLOSAR Sàrl registered in the Sarreguemines Trade and Companies Register under No. 314493479 with its registered office at 3 RUE GUILLAUME SCHOETTKE 57200 SARREGUEMINES.

Personal Data: refers to the personal information that the User has recorded when registering for the various services offered by the www.solosar.fr website.

Host: designates the host of the Site, OVH Company 2 rue Kellermann BP 80157 59053 Roubaix France.

Responsible for the website: Cyrielle MULLER

Service: designates the service of administrative formalities for company registration and the tool to help choose the legal form adapted to the User's project accessible via the Site, provided by a Partner.

Hypertext link: refers to the link that connects a word, an expression or an image of a document to another part of a document or to another file. A click on a hyperlink allows access to any file whether it is on a remote server or locally.

Partner : means a third party company which, under the conditions defined in the Contract between it and the Publisher, offers services via the Site. The identity of the Partner will be mentioned on the Site for each service provided by this Provider.

Site: refers to all the pages and documents connected by hypertext links, put online at the internet address solosar.fr and accessible in different versions depending on the medium used (desktop, mobile, tablet...)

User: refers to any person who uses the Site or one of the services offered by the Site.

 


Article 1: Purpose of the TOS

Access to the site of SOLOSAR (hereinafter referred to as "the site") is subject to these Terms and Conditions.

Constituting the contract between SOLOSAR and the User, access to the site must be preceded by acceptance of these TOS. Thus, by accessing the Site and the information it contains, the User acknowledges having read these TOU, having accepted them and agrees to comply. 

SOLOSAR reserves the right to modify these GTU at any time, without prior notice, in particular to adapt them to changes in the Site or changes in legislation.

The User therefore undertakes to consult these GTU regularly.

Article 2. Presentation and purpose of the Site

The present Site allows the User to have access, on the basis of the information that he will have informed himself :

- Restricted access to sensitive information on products sold or rented by SOLOSAR such as CE certificates, DOP, drawings and plans of products.

In addition, this Site may allow the User to have access, based on the information he has provided and under the conditions described in Article 9.5 of these Terms and Conditions :

- a form to contact our sales administration;

- a form to register to our Newsletter/E-mailing.

Article 3. Conditions of access

To access the Site, the User must be a natural person, of age and capable, or a legal entity.

The Site is accessible 24 hours a day, 7 days a week, except in the case of force majeure, third party and/or maintenance work and interventions necessary for the proper functioning of the Site. In this case, this interruption will be notified by means of a warning on the home page or by any other means. This interruption can in no way engage the responsibility of SOLOSAR and does not give right to any compensation. In addition, SOLOSAR may terminate access to the Site at any time following any breach of these T&Cs by the User.

The content and / or services offered by the Site in its desktop version are included in full on the tablet and mobile version of the Site.

Article 3. Applicable law and jurisdiction

The Site and the present GTU are subject to French law.

Its contents and services are offered in French and English. Only the French version is binding on the parties, the English version being given for information purposes only. Any dispute relating to the interpretation and execution of these TOS, which cannot be settled amicably, will be under the exclusive jurisdiction of the courts of Sarreguemines. 

Article 4. Pricing

Access to the Site and its restricted area is free.

Article 5. Information made available

The general information on the site is only indicative or informative and the User is solely responsible for the use he may make of it. Thus, this information may be modified or deleted at any time without prior notice and without justification.

SOLOSAR makes every effort to provide the User with quality information and / or tools. Despite all the care taken, delays, omissions or inaccuracies may occur.

Therefore, SOLOSAR can not guarantee the accuracy, precision, reliability and completeness of information on the Site and can not be held responsible for errors, lack of availability of information and updates, inaccuracies and / or the presence of a virus on the Site. This also applies to the road device selector made available to the User.

Article 6. Use of the Site by the User

The User is informed that the use of the Internet network does not guarantee the secrecy of correspondence; it is up to him to take all appropriate measures to protect his own data and/or tools.

The User undertakes to respect the integrity of the Site and refrains from hindering or forcing the operation of the Site, to modify, alter or delete fraudulently the contents accessible via the Site and to introduce fraudulently data.

 Consequently, SOLOSAR :

cannot be held responsible for any damage that may be suffered, during a visit to its Site, by the technical environment of the User and in particular, his computers, software, network equipment (modems, telephones, WiFi etc. ...) and any other equipment used to access or use the service and / or information.
cannot be held responsible in case of misuse of the Site by the User.
cannot be held responsible for the reliability of data transmission, access times, possible access restrictions on the Internet or networks connected to it.
cannot be held responsible in case of interruption of the networks of access to the Site, of total or partial unavailability of the Site resulting in particular from the telecommunications operator, in case of error of transmission or problems related to the safety of the transmissions, in case of failures of the material of reception or the telephone line.

When the User subscribes to these GTU for the needs of third parties (including legal entities) and when he/she provides personal information on behalf of this person, he/she certifies on his/her honour that he/she is entitled and has all the powers and authorisations necessary to subscribe to these GTU and to provide information on behalf of third parties on the Site.

Therefore, the User fully guarantees SOLOSAR from all consequences of claims from third parties (including legal entities) concerned on this authorization and/or in case of fraud by the User.

Article 7. Intellectual property rights

The User benefits, subject to acceptance of these Terms and Conditions and under the conditions set out therein, a free, personal, non-exclusive and non-transferable right to access and use the Site and its services. The Site must be considered as an indivisible whole. The Site and all elements contained therein (information, data, text, sounds, images, drawings, graphics, logos, trademarks, etc.) are the exclusive property of SOLOSAR or its partners. All these elements are subject to the provisions of the Intellectual Property Code and, as such, are protected against any unauthorized use by law or these Terms of Use. The reproduction of these elements is only authorized for information purposes and/or copies or reproductions intended for strictly private and personal use, subject to having accepted the present GCU.

Any other reproduction, representation or distribution, in whole or in part, of the content of this Site, on any medium or by any process whatsoever, is prohibited. Failure to comply with this prohibition constitutes an infringement likely to engage the civil and criminal liability of the infringer.

In particular, it is strictly forbidden to use or reproduce the name "SOLOSAR" and "SOLOSAR.COM" and / or their logo, alone or in combination, for any purpose whatsoever, including advertising, without the prior written consent of the Editor.

Similarly, downloading or any other form of copying any element or information on the Site www.solosar.fr, even if authorized, does not confer any right on them. It is strictly forbidden to reproduce them (in whole or in part), to transmit them (electronically or in any other way) and to modify them.

It is also forbidden to use this Site for advertising or commercial purposes, without the prior written authorization of the Editor.

The User also undertakes to respect the rights that third parties may have on the content or part of the content of the site.

Article 8. Hypertext links

This Site includes information provided by external companies or hyperlinks to other sites that have not been developed by SOLOSAR. The existence on the Site of a hyperlink leading to another site does not constitute an endorsement of that other site or its content. SOLOSAR therefore assumes no responsibility for these sites, their content, advertising, products or services available on or from these sites.

In addition, SOLOSAR shall not be liable for any information, opinions and recommendations made by these third parties.

Any hyperlink to the Site must be expressly authorized in advance in writing by SOLOSAR, which reserves the right to remove the link at any time.

Article 9. Restricted area

The Site offers the User to create his private online space. By creating his project space, the User benefits free of charge from an online service on a secure space that allows him :

consult private and technical documents concerning products sold or rented by SOLOSAR, print them and save them in pdf format,

9-1 Prior identification

To create his project space, the User registers his e-mail address and a password (minimum 8 characters including at least one number and one capital letter). He completes his profile by entering his surname, first name or company name, telephone number and a secret question/answer pair necessary to renew his password. An e-mail validates his registration within 48 hours.

The e-mail address provided at registration serves as a relay between the User and the Site and possibly SOLOSAR, including to be informed of the automatic closure of the account, the User is advised to keep it valid and active throughout the access to the restricted area and to regularly consult the corresponding box.

9-2 Password management

If the User forgets his password, he can renew it by clicking on the text "forgotten password". An e-mail valid for 24 hours will then be sent to the User containing a link to the password renewal page.

The User can change his password at any time directly in his restricted area.

9-3 Confidentiality

The e-mail, the password and the secret question/answer pair constitute the User's identifiers that allow him to access his restricted area. These identifiers are strictly confidential and must not be communicated to third parties under any circumstances. The User is solely responsible for the use of his identifiers, and undertakes to inform the Site as soon as possible in case of loss or theft of his identifiers via the Contact form.

Subject to the provisions of Article 9-5, SOLOSAR undertakes not to communicate to third parties the data of the User stored in its restricted area unless legally required (eg administrative or judicial injunction) or legal action taken against it by the User or a third party, provided that the action is based on the use by the User of its project area not in accordance with these Terms and Conditions and / or the law.

9-4 Closure of a restricted area

Closure at the request of the User: The User can close his restricted area online via the CONTACT US page.

Automatic closure: A restricted area can be automatically closed by SOLOSAR :

- after one (1) year of inactivity (no connection of the User for 1 year) or three (3) years after its creation date (end of validity) ;

- in case of breach by the User of these Terms or disclosure of documents relating to products sold or rented by SOLOSAR.

In this case, one (1) email alert will be sent to the User to warn him of the upcoming closure of his space.

9-5 Rules of use

As part of a responsible use of the service, the User must comply with the following rules of use:

create only one restricted space per User;
provide information and store content that are only related to his project
professional project whose activity must respect the French legislation.

The use of the restricted space must be carried out in accordance with the present TOS. Therefore, the User may not use the service to :

probe, analyze or test the vulnerability of the service and more broadly of the system environment;
Implement malicious software through the service and the wider system environment;
Violate or circumvent in any way the security or authentication measures imposed;
Tampering with, using or accessing non-public areas of the system;
impersonate any User, interfere with or disrupt any User's access;
infringe the intellectual property rights of any person;
store any material that is obscene, pornographic or incites bigotry, racism or hatred
violate the law in any way, violate the privacy of others or engage in acts of defamation.

All data stored by the User remains confidential. Any data stored and exported by the User loses its confidentiality and does not engage the responsibility of SOLOSAR.

If it is found that inappropriate content or actions against the above rules are identified, SOLOSAR reserves the right to suspend and terminate the service automatically.

Article 10. Remedies

The User may send a complaint by registered letter with acknowledgment of receipt to the following address:

If the response provided by the complaints department does not satisfy the User, the latter may refer the matter to the CNIL to assert his right of opposition and rectification.

Article 11 Personal data protection policy

The personal data protection policy sets out the manner in which the User's data is processed on the Site. TO LEARN MORE ABOUT THE PERSONAL DATA PROTECTION POLICY, THE USER MUST CONSULT THE SOLOSAR PRIVACY POLICY.

The Site uses cookies. When consulting the Site, cookies are deposited on the User's computer, tablet or smartphone. TO LEARN MORE ABOUT COOKIES AND TO SET THE PARAMETERS OF COOKIES, THE USER MUST CONSULT THE SOLOSAR PRIVACY POLICY.
